PURPOSE: To afford the Board and Superintendent the opportunity to address issues related to the current state of emergency, including the closure of schools, budgetary impact, human capital considerations, instructional continuity, and other emergency functions.  This Special Meeting conducted by The School Board of Miami-Dade County, Florida, is provided in accordance with Section 1001.372, Florida Statutes and is being held in accordance with Governor DeSantis Executive Order 20-69 Suspending Certain Statutory Public Meeting Requirements. An agenda will be available at 4:30 p.m., on Friday, March 27, 2020. The agenda can be viewed by accessing the website www.dadeschools.net under the tab Board Information.   The public may listen to or read the Closed Captioning of the live Special Board Meeting which can be found by accessing the website  www.dadeschools.net  A citizen wishing to comment on an Agenda item may submit their comments in writing via-email of up to 250 words to the email address Agendacomments@dadeschools.net by noon on Monday, March 30, 2020, so that your comments can be read into the record and addressed by The School Board under the specific agenda item.  For further information, email the Superintendent’s Agenda Office at Agendaoffice@dadeschools.net If you have difficulty accessing the live meeting please contact the District at  305-995-3000.

SUBJECT: SUPERINTENDENT’S ORAL REPORT TO THE SCHOOL BOARD AND COMMUNITY REGARDING MIAMI-DADE COUNTY PUBLIC SCHOOLS’ RESPONSE TO THE COVID-19 EMERGENCY AND STATUS OF DISTRICT OPERATIONS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, receive the Superintendent’s oral report to the School Board and community regarding Miami-Dade County Public Schools’ response to the COVID-19 emergency and status of district operations.  

 

SP-2              

SUBJECT: MONTHLY FINANCIAL REPORT FOR THE PERIOD ENDING JANUARY 2020

RECOMMENDED: That The School Board of Miami-Dade County, Florida, receive    and file the Monthly Financial Report for the period ending January 2020.

 

SP-3              

SUBJECT: ADOPTION OF EMERGENCY POLICY 0165E, PUBLIC MEETINGS DURING DECLARED COVID-19 EMERGENCY

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

  1. find that the emergency policy is necessitated by the immediate danger caused by the Covid-19 pandemic; and
  2. adopt Emergency School Board Policy 0165E, Public Meetings During Declared COVID-19 Emergency, to be effective March 31, 2020.

 

SP-4              

SUBJECT: PROVISION OF LEGAL REPRESENTATION FOR THE FOLLOWING MATTER: Efren Grafals and Samantha Grafals, Individually and as Parents of R.G., a minor v. The School Board of Miami Dade-Dade County, Mayte Zayas and Bruce Berman
Case No. 2020-CA-002925-CA 01

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Office of the School Board Attorney to provide or secure legal representation for the legal defense of the current School Board employees who are individually named as defendants in the case of Efren Grafals and Samantha Grafals, Individually and as Parents of R.G., a minor v. The School Board of Miami Dade-Dade County, Mayte Zayas and Bruce Berman, Circuit Court Case No. 20-002925-CA 24.

 

SP-5                          

SUBJECT:  MIAMI-DADE COUNTY SCHOOL BOARD v. JOSE A. PALOMINO, DOAH Case No.  18-6502

RECOMMENDED: That The School Board of Miami-Dade County, Florida approve the proposed Settlement Agreement in the case of Miami-Dade County School Board v. Jose A. Palomino, DOAH Case No. 18-6502, suspending Respondent without pay for the period of his suspension already served and reinstating him to his position as a Security Specialist with the School Board under the conditions specified in the Settlement Agreement.

 


SP-6              

SUBJECT: TENTATIVE PLAN TO PROVIDE AN OPPORTUNITY FOR PARENTS, COMMUNITY MEMBERS, AND STAKEHOLDERS WHO MAY WISH TO SPEAK TO THE BOARD ON AN AGENDA ITEM OR AT A PUBLIC HEARING VIA TELECONFERENCE TECHNOLOGY

ACTION PROPOSED BY MS. MARIA TERESA ROJAS: That The School Board of Miami-Dade County, Florida, authorize the Superintendent of Schools to explore the feasibility of developing a tentative plan to provide an opportunity for parents, community members, and stakeholders who may wish to speak to the Board on an agenda item or at a public hearing via teleconference technology in the event of a Coronavirus outbreak in Miami-Dade County, Florida, and report to the Board by April 22, 2020, or as soon as practicable.

 

SP-7              

SUBJECT: ANNUAL REVIEW PROCESS FOR THE PROMULGATION, CHANGES, AND/OR AMENDMENTS TO SCHOOL BOARD POLICIES FOLLOWING THE FLORIDA STATE LEGISLATIVE SESSION

ACTION PROPOSED BY MS. MARIA TERESA ROJAS: That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to review the current process for the promulgation, changes, and/or amendments to School Board policies following the Florida State Legislative session and any Federal Legislative changes, report to the Board at the Fiscal Accountability & Government Relations Committee of July, 2020.

 

SP-8

SUBJECT: PARENTAL AND RELATED STAKEHOLDER NOTIFICATION REGARDING SCHOOL INCIDENTS

ACTION PROPOSED BY DR. STEVE GALLON III: That The School Board of Miami-Dade County, Florida, direct the Superintendent to:

  1. review existing procedures, practices, and policies that govern notification, through general and/or legally sufficient statements, to parents and related stakeholders about serious incidents in schools;
  2. ensure that notifications regarding serious incidents at schools are sent prior to the evening television news cycle and no later than the end of the day in which the serious incident occurred, as appropriate; and
  3. initiate rulemaking or amendment to School Board Policy 9120 to ensure timely notification to parents and related stakeholders when serious incidents occur at schools.

SUBJECT: COMPENSATION OF PART TIME/HOURLY EMPLOYEES DURING CURRENT COVID-19 MANDATED SCHOOL CLOSURE

ACTION PROPOSED BY DR. STEVE GALLON III: That The School Board of Miami-Dade County, Florida,direct and affirm, the Superintendent’s development, and upon review,  implementation of an immediate plan of action to provide for legally permissible work related engagement and compensation of part-time/hourly employees within the approved financial resources reflected and funded in the 2019-2020 district budget ending June 30, 2020.  This plan is to be developed and implemented in a manner consistent with and inclusive of recommended CDC guidelines that include but are not limited to social distancing. 

 

SP-10

SUBJECT: SCHOOL BOARD APPROVAL TO AUTHORIZE THE SUPERINTENDENT OF SCHOOLS TO REVIEW AND PRESENT TO THE BOARD A PLAN TO PROVIDE PART-TIME HOURLY COMPENSATION DURING THE CURRENT STATE OF EMERGENCY  

ACTION PROPOSED BY MARIA TERESA ROJAS: That The School Board of Miami-Dade County, Florida, authorize the Superintendent of Schools to review and present to the Board a plan to provide part-time hourly employees compensation during the current state of emergency.
